1. Limited Warranty; Exclusion
Skytech II, LLC. (hereafter referred to as the “Company”) warrants that each new product manufactured by Company, including all transmitters, receivers, control modules, hardware, and other components (collectively referred to as the “System”), will be free from material and workmanship defects, provided these products are used strictly according to the instructions supplied by the Company for each System and are properly installed (hereinafter referred to as the “Limited Warranty”). This Limited Warranty is expressly limited to the original retail purchaser of the System (hereafter referred to as the “Customer”) and will be deemed null and void upon any sale or transfer of the property where the Customer has installed the System. This Limited Warranty is non-transferable and defines our exclusive and limited liability and remedies for any nonconformity, defect, or similar claim. The Limited Warranty is null and void in the event of damage to the System, modification of the System, or use of the System contrary to its documentation.
The foregoing warranty and other Company obligations in this document do not extend to any components, batteries, software, or other products furnished by third parties (the “Third Party Items”). Company disclaims all warranties, express and implied, relating to the Third Party Items. Customer should consult relevant third party documentation for the Third Party Items for any protections or other terms relating to those items.
2. System Sold As Is; Liability
Subject to this Limited Warranty and any applicable state law, each System, including any Third Party Items, is sold by the Company to a Customer on an “as is” basis. The Company’s obligations are subject to all additional disclaimers, limitations, reservations of rights, exclusions, and qualifications detailed on the Company’s website, www.skytechpg.com, all of which are considered part of the Warranty and incorporated herein (collectively, the "Additional Terms”). Each Customer agrees to the Warranty and the Additional Terms by using any System or any part of it.
Company and its affiliates, distributors, and resellers disclaim all liability for consequential, incidental, exemplary, lost profits, and other similar damages. In no event will the liability of the foregoing parties for all damages every kind and type (whether arising in contract or tort) exceed, in the aggregate, the initial purchase price paid for the System. Any claim brought by Customer relating to this Limited Warranty must be brought against Company, alone, not Company’s affiliates, resellers, and distributors.
3. Repair or Replacement of System or Parts
If the System or any of its parts qualifies for repair or replacement due to material or workmanship defects, the Company will repair or, at its discretion, replace the defective System or part, provided the Customer complies with all terms and conditions outlined herein regarding service and claims under the Limited Warranty. The Company will supply System replacement parts at no charge for the first five (5) years of the Limited Warranty to the original Customer. Gas valves and their related components will be provided at no charge for one (1) year. A comparable replacement product will be supplied if the Company does not have the original System purchased.
4. Warranty Claims; Skytech Service
To submit a valid warranty claim, a Customer must comply with the following requirements:
- Contact the Company at (855) 498-8324 to get a Return Material Authorization (“RMA”) number; and
- Submit proof of purchase, along with your name, address, email, and phone number.
- Please provide the product model name and describe the nature of the defect, nonconformity, or other issue.
- Provide such notice within thirty (30) days of discovery of such defect, nonconformity, or problem;
- Securely pack and ship the product to Skytech II, LLC, ATTN: Warranty Department, 9230 Conservation Way, Fort Wayne, IN 46809.
- The Customer is responsible for all costs and risks associated with shipping the product to the Company. (i) The RMA number is valid for thirty (30) days from the date of issuance. (ii) The RMA number must be clearly marked on the outside of each package that is being returned.
- The Company may refuse shipments that do not satisfy all requirements for a valid claim. The Company is not responsible for any refused shipments or any damage sustained during shipping, regardless of whether it involved a valid claim.
- The Company will be responsible for return shipping charges.
Upon receipt of a valid claim and the properly returned item, the Company shall, at its option, either (a) repair the System at no charge to the Customer, (b) replace the returned System with a new comparable System at no charge to the Customer, or (c) provide the Customer with a refund equivalent to the price paid for the defective system, excluding any service or labor costs associated with installation or otherwise.
Any system, hardware, or component repaired under this agreement, as well as any replacement component, shall retain the remaining duration of the Limited Warranty.
Any obligation of the Company under Section 3 shall remain subject to the Company’s right to physically inspect the defective product(s). Some states do not allow the exclusion or limitation of incidental and consequential damages or the limitations on how long an implied warranty lasts; therefore, the above limitation may not apply to you. This Limited Warranty provides you with specific rights; you may have other rights varying from state to state, province, or nation. To the extent allowed by law, the liability of the Company is limited to the express terms of this Limited Warranty, and the Company expressly disclaims any other express or implied warranties, including any warranties of fitness for a particular purpose or merchantability.
